Two internet sites, which offer online dating services, have taken one another to Federal Court
Both online dating web sites are fighting it out in New York City’s Federal Court, where Anastasia International has accused EM Online Ltd. dba Elena’s Models with false advertising, infringement of Anastasia’s brand name and attempting to fabricate fake testimonials against the site. For their internet site, Anastasia makes use of the domain names Anastasiadate along with Anastasiadate.com. Regardless of the misconception that EM Online are based in America, they’re in fact operating out of Australia.
“The Complaintant offers an international internet dating service which, for a fee, matches up males in the U.S with girls situated in Russia and Ukraine. NYC holds the main market for Anastasia”, the plaintiff states. “EM Online directly impedes upon Anastasia’s market. “Upon info and belief, Elena’s Models operates or sponsors website pages titled ‘anastasiadatefraud.com’ and ‘ruadventures.com.'”. Both these websites disguise the identity of their owners by using a proxy service. Despite this, they “coincidentally” redirect viewers to elenasmodels.com. The basis of the false marketing accusation stands due to the fact the two websites accuse Anastasiadate of carefully and indefinitely scamming customers and deceive the clientele when purchasing their services, and then will continue to claim that the accused, elenasmodels.com, is really a totally safe and reliable dating site. “The anastasiadatefraud.com website proposes to show extracts from e-mails written by women with user profiles on Anastasiadate.com. The e-mail extracts all have a common message – the ladies featured on Anastasiadate.com are not truly hunting for a relationship with men from the United States, but rather are contract workers paid to correspond with Anastasia clients and break their hearts. The emails from the ladies are definitely fake, making these suggestions false. Anastasiadate goes to great length to ensure the men.”
Elena’s Models knows the claims it makes on anastasiadatefraud aren’t true, and had the emails written particularly to harm Anastasia’s business, the complaint states. Quite unjustly, Elena’s Models is using ruadventures.com to fend off any competition so that it can prosper at their expense. “This website, despite claiming to be a forum focused on reviewing online dating services, is in fact noted to be quite picky as it promotes Elena’s Models solely while looking to damage other companies. The web site contains false information about customers’ use of the Anastasiadate service which .. has been fabricated by Elena’s Models,” or so the accusation says.
Anastasia claims that ruadventures.com infringes on its copyrighted logo to swipe potential customers. “Because of how search engines work, while using Anastasiadate’s trademarks has made ruadventures.com a lot more visible on Google, Yahoo, Bing and other search engines,” the complaint states. Anastasia seeks an initial and long-term injunction, and treble and punitive damages. The company represented by Richard C. Yeskoo with Yeskoo Hogan & Tamlyn.
Anastasiadate.com gives American men the chance to meet “some of the world’s most beautiful women!” “Few other international dating web page comes close,” according to the site. The web page describes itself as “the easiest method to find real women online, with the best customer protection available on a dating site.
An anonymous writer, posting on anastasiadatefraud.com, claims to know every secret behind Anastasiadate. He claims Anastasiadate pays third-party firms to hire “females” who are paid out to converse with customers. He claims he knows this because a woman he chatted with in Ukraine had informed him how Anastasiadate works. Women are assured lots of money and decent work hours, just by chatting and emailing American men, by a third party company attached to Anastasiadate. The only listed qualifications are to be 18 or older, to know English, and to know how to work with a computer, according to the website.
According to the same writer, the woman recommended Elena’s Models since, according to her, was a much more serious site.
